Elements Of Calusa Lakes Deed Restrictions Include:
Note - these are excerpts for illustration purposes; the full deed restrictions should be examined before purchasing property as they are strictly enforced by the Calusa Lakes Board, proven copious managers of rules.  Violators are subject to letters of warning, reprimand, and fines.  Deed restrictions are serious business, it's prudent to learn and obey them when living in the community. 

Advanced Management, Inc. of Southwest Florida (AMI) has been contracted to manage all four of the homeowners’ associations in Calusa Lakes (493-0287). AMI’s mailing address is 899 Woodbridge Drive, Venice, FL 34293.

COVENANT ENFORCEMENT
Protective covenants, otherwise known as Deed Restrictions, allow a community to have standards of architecture, landscape and behaviors, which provide common criteria for property and living. They protect the value of homeowners by maintaining a community to the standards it was developed. When homeowners or their lessees fail to abide by the covenants, they are notified by letter, given the opportunity to correct the situation and if a violation continues, they may be fined. Please remember, before you make any changes to the exterior, lot or structure, you must get approval from the Architectural Review Committee. You can do this by submitting your written request for approval along with your plan to AMI. When you get approval the contractors working at your home need to follow community rules:

- No work on Sundays (this includes landscape vendors, too)

- No contractor signs can be posted on lot

- No trucks or trailers are permitted to be left on the street or property overnight

For clarification, a change in landscaping includes, (but is not limited to):

- Adding or expanding existing beds,

- Adding or removing trees

- Adding lighting or pathways

- Other changes to landscape may also be considered a change requiring approval.

Some examples include:

- If a specimen plant or tree is removed by approval, and it had fulfilled the requirement for a 5’ specimen at the corner of the home, this will need a replacement

- If flowering bushes are removed that had meet the requirement for two flowering bushes in the front or back, they will need replacement with a flowering bush

- If a number of bushes are removed, leaving a large blank area, this will be considered a change in landscape and will need a replacement plan

- If a tree is trimmed so severely that it dies, it will need to be replaced and may be subject to the fine for an unauthorized tree removal.

For clarification, a change to the exterior includes, (but is not limited to):

- Installing storm shutters

- Changing paint color

- Adding or altering to the home, garage or exterior lighting

- Changing the walks or driveways (size, finishes or replacement)

- Any street side ornamentation, including urns, benches and flower pots

- Awnings and other items inside the cage of the lanai are not considered “exterior” for these purposes

QUICK LIST OF ”DOs AND DON’Ts

Also detailed throughout our Protective Covenants are what some might call our “GOOD NEIGHBOR DOs AND DON’Ts.” For your convenience, we have summarized the highlights:

DOs

- Keep lawn and vegetation neatly maintained. Replace the dead areas as required.

-Keep all roofs and surfaces free of mildew, stains, and caulking.

- Maintain your sprinkler system. Water only on your scheduled day and time.

- Keep mailboxes in good condition, with approved standard paint colors. Make sure that plantings around your mailbox are below the horizontal support.

- Keep garage doors closed when not in use.

- Park all vehicles in a garage overnight.

- Notify AMI so that a guest’s car may be parked overnight in your driveway, for up to four nights. For stays of five to 15 days, a parking permit will be issued, which may be renewed only once.

- Make sure your exterior lighting is directed away from neighboring residences and streets.

- Ensure your pet is a “good neighbor,” too. They must not be a nuisance to other residents.

- Keep “stuff” stored out of sight, including sports equipment, baby strollers, wading pools, etc., and trash, clippings, and tools.

- Report to the police anyone suspicious who comes to your door selling or offering services - outside solicitors are not permitted in Calusa Lakes.

- Inform AMI in writing if you intend to rent your property for an allowable period of six months or more. Homeowners are responsible for their property and renters’ compliance with its covenants.

- Schedule maintenance of your irrigation system on Wednesday’s when the system is always on for repairs and adjustments by homeowner or sprinkler service.

DON'Ts

Unless approved by the CLCA Board, the following are NOT permitted. However, special seasons or circumstances may, at times, necessitate temporary relaxation of some restrictions.

- NO trucks, campers, motor homes, buses, boats, or trailers may be parked outside.

- NO walls or fences outside the building setback lines.

- NO swing sets, sheds, or similar structures: no awnings, canopies, or shutters.

- NO artificial vegetation, exterior colored lighting: no outdoor clothes drying, lines, or poles.

- NO street-side decorative objects, lawn ornaments, sculptures, signs, flagpoles, benches, etc.  This specifically includes vendor and political signs.  

- NO garage, yard, or similar sales

STORM PROTECTION
None may be installed prior to June 1 or removed later than November 30, without Board approval.

1) Shutters that are clear, white or painted the color of the house (plastic, wood, and metal are acceptable)

2) Plywood which is painted white or the color of the house and cut to fit inside the window or door opening.

3) High-impact windscreens installed on the lanai under the roof line.

For short-term protection, the following may be installed when a storm is imminent (as indicated by a hurricane or tropical storm watch or warning, issued by the National Weather Service.) These must be removed within a week after the watch or warning has been canceled.

1) Unpainted wood or metal/aluminum shutters

2) High-impact windscreens for windows and doors, except on the lanai as described above

No storm protection system may be stored outside the house.

GARAGE DOORS & NIGHT PARKING
GARAGE DOORS ALWAYS ARE TO BE CLOSED when not in use. There is absolutely no parking on the street overnight, and all vehicles are to be kept  inside a garage. Occasional OVERNIGHT VISITORS may park in an owner’s driveway overnight by calling AMI to register its make and license number. For those cars parked overnight for 1 to 4 DAYS and not more than two times per calendar month, no permit sign is required. For each guest vehicle parked overnight for 5 to 15 DAYS, a parking permit must be obtained from AMI and displayed in the windshield. This permit may be renewed only once for up to 15 additional days and cannot be reissued, for the same guest vehicle, more than two times per calendar year.

HOLIDAY DECORATING - COLORED LIGHTING
Only for certain holiday periods may street-side yard decorations or outdoor colored lighting be displayed. At Easter, 4th of July, Halloween, and Thanksgiving, limited and appropriate displays may be installed no sooner than two-weeks prior to and removed one week after each holiday. Christmas decorations may go up the day after Thanksgiving but must be removed by January 10.

EXTERIOR CHANGES
Home exterior design, color, and landscaping were approved at the time of construction by the Board’s Design/Development Committee. Any significant change to the exterior appearance of your home and lot (e.g., structure, paint colors, driveways, landscaping, etc.) requires prior approval from them, as well. Please contact AMI with your written request for approval.

TREE CUTTING
Sarasota County and Calusa Lakes are very environmentally conscious of the special beauty and practicality of our trees. By law and by CLCA covenants, no tree may be removed from your property, whether alive, dying, dead, or diseased, without prior written approval. Violators are subject to fines and tree replacement costs.

MAILBOX PAINT
Approved-color paints may be purchased at Porter Paints (924-3111) in Sarasota, which is located on US 41 across from Shells restaurant. They have the special formulations for our colors--Calusa Lakes Brown, Brilliant White, and Teal. Regular maintenance of the mailbox and post is required.
